23 Red States Support FMCSA CDL Restrictions in Lujan vs. FMCSA Case

Twenty-three states with Republican governors have filed an amici curiae brief in Lujan vs. FMCSA, supporting the federal rule that restricts states from issuing commercial driver licenses to foreign-domiciled residents. The rule, finalized in February, allows CDLs only for holders of H-2A, H-2B, or E-2 visas. The brief cites a fatal crash by an unauthorized driver as evidence of need. The D.C. Court of Appeals will hear oral arguments on September 15. The case could tighten the driver pool for trucking companies relying on foreign-born drivers.
