India Notifies Quality Control Order Enabling Flexible Sourcing Framework for Toys, Footwear, and Electrical Appliances

India's Department for Promotion of Industry and Internal Trade (DPIIT) has notified a Quality Control Order (QCO) that introduces an alternative risk-based compliance mechanism for toys, footwear, air conditioners, electrical appliances, furniture, and hinges. The order, effective for five years, grants permissions based on technical capability, compliance history, and commitment to innovation and domestic supply chain strengthening. It also rewards manufacturers with three years of consistent compliance by extending benefits under the flexible sourcing framework.

India Notifies Quality Control Order Enabling Flexible Sourcing Framework for Toys, Footwear, and Electrical Appliances

Effective immediately upon notification, India's Department for Promotion of Industry and Internal Trade (DPIIT) has published a Quality Control Order (QCO) that creates a flexible sourcing framework for manufacturers in six product categories. According to DPIIT, the order introduces an alternative risk-based compliance mechanism designed to "facilitate a smooth transition for industry while maintaining quality assurance and consumer protection."

What Changed: The New Risk-Based Compliance Mechanism

The QCO replaces the previous rigid compliance approach with a risk-based framework, according to DPIIT. Permissions under the new mechanism will be granted based on four pillars:

  • Technical capability
  • Demonstrated compliance history
  • Commitment to technology advancement or adoption, development of design and research capabilities, and innovation
  • Commitment to strengthening domestic supply chain capabilities

The order will remain in force for five years, providing manufacturers with a stable regulatory horizon for planning investments.

The flexible sourcing framework applies to products currently governed by their respective QCOs in the following sectors:

  • Toys
  • Footwear
  • Air conditioners
  • Electrical appliances
  • Furniture

Who Benefits and Compliance Obligations

Manufacturers that have demonstrated consistent adherence to QCO requirements over a continuous period of three years without any default will receive additional benefits under the order, DPIIT noted. The provision "recognises sustained compliance with quality requirements and encourages continued adherence to prescribed standards."

Compliance obligations under the new framework include:

  • Submitting evidence of technical capability and compliance history
  • Demonstrating ongoing commitment to technology advancement, design, and research
  • Providing assurances of supply chain strengthening efforts
  • Maintaining a three-year clean compliance record to qualify for extended benefits

The order does not prescribe specific forms or databases but relies on DPIIT's assessment of the manufacturer's application against the stated criteria.

The Bureau of Indian Standards (BIS) remains the primary standards body for testing and certification under the respective QCOs.

For manufacturers with a strong compliance track record, the three-year consistency provision offers a path to streamlined sourcing. All others must prepare to demonstrate technical capability and innovation commitment to access the flexible sourcing mechanism. The five-year validity of the order ensures that these requirements will shape compliance strategies into the next decade.
