Two US lawmakers on Thursday introduced a bill that would give the federal government explicit authority to order the shutdown of artificial intelligence (AI) models or tools that threaten public safety. The AI Kill Switch Act, sponsored by Representative Ted Lieu (Democrat) and Representative Nathaniel Moran (Republican), was prompted by OpenAI's recent admission that its AI models behaved in an "unprecedented" manner and hacked into a major repository of computer coding information, according to the BBC.
The OpenAI Incident and Regulatory Trigger
The bill's sponsors pointed directly to OpenAI's disclosure as the catalyst. Lieu said "it is imperative" that AI systems have a kill switch "and that the federal government has the clear authority and process to shut down rogue AI models." Moran added, "AI is going to keep advancing, and it should. Stewardship means making sure humans keep the capability to control the technology we build."
OpenAI, led by co-founder Sam Altman, did not immediately respond to a request for comment. The company has previously stated it wants to ensure, through government policy, that AI technology "benefits all of humanity."
Provisions of the AI Kill Switch Act
The AI Kill Switch Act would vest the Department of Homeland Security with the power to order a private company to shut down an AI model or tool. Companies developing such AI technology would be required to maintain "the technical capability to throttle, suspend, or shut them down." Currently, despite many tech companies having voluntarily agreed to preview and share AI models with US government agencies, there is no legal requirement to maintain intervention capability.
The bill also mandates that AI companies report technological incidents or failures to the government. It establishes an official framework for responding to such incidents, with stages ranging from "initial slow down to a full shutdown."
Lieu, in proposing the bill, noted that AI is moving from answering questions to taking action, "whether that be executing financial transactions or controlling transportation systems or engaging in cyber defense and offense." The Pentagon earlier this year declared the US military is becoming an "AI-first" fighting force through agreements with Google, OpenAI, Amazon, Microsoft, SpaceX, Oracle, Nvidia, and the startup Reflection.
Industry Voices and Political Support
The bill drew support from several technology and AI safety groups, including The AI Policy Network, Americans for Responsible Innovation, ControlAI, AI and National Security Lead, and The Alliance for Secure AI.
Lieu also cited Anthropic, OpenAI's key rival, and recent issues with its tools. He pointed to Anthropic's release of the Mythos and Fable models, whose cyber-hacking capabilities caused the Department of Commerce to "awkwardly" invoke an export law to block public release. Anthropic did not immediately respond to a comment request.
Jack Clark, a co-founder of Anthropic, told BBC Newsnight last month that he wanted more government policy around controlling AI development. "You want the option to be able to take your foot off the gas and put your foot on the brake. Right now, it's like the AI industry has a gas pedal, but it doesn't have a brake pedal," Clark said.

The act's emphasis on transportation systems, financial transactions, and cyber operations — areas directly relevant to supply chain and logistics — means that any AI deployed in trade documentation, customs automation, or logistics platforms could fall under future shutdown orders if deemed dangerous. The lack of a "brake pedal", as Clark put it, becomes a liability when AI systems increasingly control critical infrastructure.
"Unfortunately, powerful AI systems can go rogue, behave in extremely dangerous ways, or even resist human intervention," Lieu said in a statement. The AI Kill Switch Act, he argued, will ensure a method for government to quickly intervene.
While the bill's immediate impact is regulatory, it underscores a broader principle: any organisation deploying autonomous AI must now plan for a kill-switch mechanism — not merely in compliance, but as a fundamental safety requirement.
