Texas Resumes CDL Issuance for Temporary Farm Workers

The Texas Department of Public Safety has resumed issuing non-domiciled commercial driver’s licenses (CDLs) to temporary agricultural workers with H-2A visas, following federal approval. This policy change is expected to impact logistics operations by potentially increasing the availability of commercial drivers in the state.

Context of the Policy Change

The resumption of CDL issuance comes after the Federal Motor Carrier Safety Administration (FMCSA) revised regulations, narrowing eligibility for non-domiciled CDLs. Previously, Texas had suspended these licenses while ensuring compliance with updated federal requirements. The move aligns with federal efforts to tighten documentation and eligibility standards for foreign-born commercial drivers.

Impact on Logistics Operations

The change primarily affects logistics operations in Texas, where there are currently between 6,000 to 9,600 non-domiciled CDL holders. With the reinstatement of CDL issuance, logistics managers and freight forwarders can expect a potential increase in driver availability, which may alleviate some capacity constraints in the region.

  • Affected Trade Lanes: Primarily impacts road freight within Texas and potentially neighboring states.
  • Operational Implications: Increased driver availability could reduce delays and improve delivery timelines for agricultural and other freight.

Recommendations for Shippers and Operators

Logistics managers and freight forwarders should monitor the availability of H-2A visa holders with CDLs as a resource for addressing driver shortages. Engaging with local driver recruitment agencies may also be beneficial to capitalize on the increased pool of eligible drivers.

"The resumption of CDL issuance to H-2A visa holders is a significant step in addressing driver shortages and improving logistics efficiency in Texas," said a spokesperson from the Texas Department of Public Safety.

Watch List

  • Federal Audits: Ongoing nationwide audits of non-domiciled CDL programs could lead to further regulatory changes.
  • Visa Holder Guidance: Awaiting further guidance on CDL issuance for H-2B and E-2 visa holders.
  • Driver Availability: Monitor the impact on driver availability and logistics capacity in Texas.
