SC Cuts Duty on Exxsol Hexane to 2.5% After Ruling

The Supreme Court of India has delivered a significant ruling affecting the import duties on Exxsol Hexane, a product used extensively as a processing solvent in various industrial applications. The court's decision, announced on May 25, 2026, reclassifies Exxsol Hexane as a pure hydrocarbon, thereby reducing its import duty to 2.5%.

Background

The case arose from a dispute between the customs department and Reliance Industries Limited (RIL). The customs department had classified Exxsol Hexane as a petroleum oil, which attracted a higher duty. However, RIL argued that the product should be classified as a pure hydrocarbon, which would qualify it for a lower duty rate.

Court's Decision

A bench comprising Justices Aravind Kumar and Prasanna B Varale upheld the earlier decision by the Customs Excise and Service Tax Appellate Tribunal, which favored a lower duty classification. The court noted that Exxsol Hexane is a saturated acyclic hydrocarbon and does not contain any additional substances that would classify it as a mixture.

"The customs department cannot be unjustly enriched due to wrong classification of products," the court stated, emphasizing the importance of correct product classification under the Harmonized System Nomenclature Notes.

Implications

The ruling has significant implications for the import-export sector, particularly for companies dealing with hydrocarbons. The decision is expected to reduce costs for importers of Exxsol Hexane and potentially increase trade volumes.

This decision underscores the importance of accurate product classification in international trade, impacting both revenue and compliance for businesses involved in the import and export of chemical compounds.
